Terms of Service

• By accessing and using FolaFutbol's Services, you accept and agree to be bound by these Terms, our Privacy Policy, and our Cookie Policy.
• If you are registering on behalf of a minor (under 18), you represent that you are the parent or legal guardian of that minor and you accept these Terms on their behalf.
• If you are registering on behalf of a school or organization, you represent that you have the authority to bind that entity to these Terms.
• These Terms apply to all users, including students, parents/guardians, coaches, school administrators, and visitors.
• We may update these Terms from time to time. Material changes will be communicated by email to registered users and by posting a notice on our website at least 30 days before the changes take effect. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

• FolaFutbol provides soccer training, STEM education, and community programs for youth.
• Programs include school-based activities, travel teams, competitive leagues, educational workshops, and summer camps.
• Our online platform provides dashboards for students, parents, coaches, and schools to manage enrollment, track progress, communicate, and access educational resources.
• AI-powered features provide personalized recommendations, drill suggestions, session planning, and progress insights.
• Services are delivered in partnership with schools, community organizations, and directly to families.
• Program availability, schedules, pricing, and offerings may vary by location and season. We reserve the right to modify, suspend, or discontinue any program or feature at any time with reasonable notice.

• To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
• You are responsible for maintaining the confidentiality of your account credentials (username and password). You agree to notify us immediately of any unauthorized use of your account.
• You are responsible for all activities that occur under your account. FolaFutbol is not liable for any loss or damage arising from unauthorized use of your account.
• You must be at least 13 years old to create an account. Users under 13 must have an account created by their parent or guardian, and parental consent is required (see Children's Terms below).
• You may not create more than one account per person. You may not share your account with others or transfer your account to another person without our written consent.
• We reserve the right to suspend or terminate accounts that violate these Terms or that are inactive for more than 24 months.

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Services in any way that violates any applicable federal, state, local, or international law or regulation.
• Engage in bullying, harassment, intimidation, or discriminatory behavior of any kind toward other users, staff, coaches, or students.
• Upload, post, or transmit any content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
• Impersonate any person or entity, or misrepresent your identity or affiliation with any person or entity.
• Attempt to gain unauthorized access to other users' accounts, our systems, or our databases.
• Use automated tools (bots, scrapers, crawlers) to access the Services without our express written permission.
• Upload or transmit viruses, malware, or any other harmful code that could damage or interfere with the Services.
• Interfere with or disrupt the Services or servers or networks connected to the Services.
• Use the Services to collect personal information about other users without their consent.
• Violate any safety rules, program guidelines, or Code of Conduct during in-person or virtual program activities.

Violation of these rules may result in immediate account suspension or termination, removal from programs, and potential legal action.

• FolaFutbol's programs primarily serve youth, including children under 13. We are committed to the safety and privacy of all participants.
• Children under 13: A parent or legal guardian must create and manage accounts for children under 13. We require verifiable parental consent before collecting any personal information from children under 13, in compliance with COPPA.
• Teens 13-17: Teens may create accounts with parental awareness. Parents/guardians retain the right to review, modify, or delete their teen's account and data at any time.
• Parents/guardians are responsible for supervising their child's use of the Services and ensuring they follow the Code of Conduct.
• We do not knowingly market to children under 13 or serve behavioral advertising to minors.
• Photos and videos of students taken during programs may be used for educational and promotional purposes unless a parent/guardian opts out by notifying us in writing.
• For complete details on how we handle children's data, please see our Privacy Policy, Section 6 (Children's Privacy).

• All content on our website and platform, including text, graphics, logos, images, software, curriculum materials, and videos, is the property of FolaFutbol or its licensors and is protected by copyright, trademark, and other intellectual property laws.
• The FolaFutbol name, logo, and program names are trademarks of FolaFutbol. You may not use our trademarks without our prior written permission.
• You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit our content without our written permission.
• Student work created during programs (artwork, writing, projects) remains the property of the student. By submitting work to our platform, students (or their parents on their behalf) grant FolaFutbol a non-exclusive, royalty-free license to display it within the platform for educational purposes.
• User-generated content (comments, messages, feedback) that you submit remains yours, but you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute it in connection with the Services.

9.1 Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

9.2 Assumption of Risk

• Participation in sports and physical activities involves inherent risks of injury. By enrolling a participant, you acknowledge and accept these risks.
• FolaFutbol maintains appropriate insurance coverage but is not liable for injuries that occur during normal program activities unless caused by our negligence.
• Parents/guardians are responsible for ensuring students are physically fit to participate and for disclosing any medical conditions or allergies.
• Emergency medical treatment will be sought if necessary, and related costs are the responsibility of the parent/guardian.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FOLAFUTBOL, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (C) ANY CONTENT OBTAINED FROM THE SERVICES; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to defend, indemnify, and hold harmless FolaFutbol, its officers, directors, employees, contractors, agents, licensors, and partners from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the Services; (c) your violation of any rights of a third party; or (d) any content you post, upload, or otherwise make available through the Services. This indemnification obligation will survive the termination of your account and these Terms.

• You may terminate your account at any time by contacting us at info@folafutbol.com or through your account settings. Account termination does not automatically entitle you to a refund of program fees.
• We may suspend or terminate your account immediately, without prior notice, if: (a) you violate these Terms, (b) you engage in conduct that could harm FolaFutbol, other users, or third parties, (c) we are required to do so by law, or (d) we discontinue the Services.
• Upon termination, your right to use the Services ceases immediately. We may delete your account data in accordance with our data retention policy (see Privacy Policy, Section 4).
• The following sections survive termination: Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and Dispute Resolution.

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.

Dispute Resolution Process

• Informal resolution: Before filing any claim, you agree to try to resolve the dispute informally by contacting us at info@folafutbol.com. We will attempt to resolve the dispute within 30 days.
• Mediation: If informal resolution fails, either party may initiate non-binding mediation administered by a mutually agreed-upon mediator in New York City.
• Arbitration: If mediation is unsuccessful, disputes will be resolved through binding arbitration in New York City, administered under the rules of the American Arbitration Association (AAA). The arbitrator's decision will be final and binding.
• Exceptions: Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access to the Services. Claims in small claims court are also permitted.
• Class action waiver: You agree that any dispute resolution will be conducted on an individual basis and not as a class action, consolidated, or representative proceeding.

We reserve the right to modify these Terms at any time. When we make material changes, we will: (a) update the "Last Updated" date at the top of this page, (b) post a prominent notice on our website, and (c) send an email notification to registered users at least 30 days before the changes take effect. Your continued use of the Services after the effective date of the revised Terms constitutes acceptance. If you do not agree with the changes, you must stop using the Services and may request account deletion.
